These Service terms (hereinafter referred to as the Terms) are entered into by and between you and us, concerning your use of the standalone desktop application named ExifHelper (hereinafter referred to as the Application or Software) provided by us. This Application enables users to view and modify Exif information of images without involving any network connection functionality.
2. Software Use
2.1 Software License
By downloading and installing this application, we grant you a non-exclusive, non-transferable, personal right to use it. You are prohibited from using the software for commercial distribution, rental, lending, or any form of bulk reproduction.
2.2 Use Limitations
You undertake to use this Software solely within the scope of legality, respecting copyright laws and other relevant statutes, refraining from engaging in any acts that infringe upon others’ intellectual property rights through the use of this Software, including but not limited to tampering with others’ Exif information for purposes of forgery or misleading others.
3. Your Responsibilities
3.1 Data Safety
As this Application is a standalone application with all operations performed locally, you are solely responsible for safeguarding your own image data. We shall not be held liable for any loss or damage to such data resulting from user errors, system malfunctions, or any other causes.
3.2 Legal Compliance
You must ensure that the images and their associated Exif information you process comply with applicable laws and do not contain any illegal, pornographic, or violent content or other illegal content.
4. Disclaimer
We shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of factors beyond our reasonable control, such as hardware failures or operating system issues.
5. Software Updates
We will strive to provide a stable version of the application, but do not make any commitment to ongoing updates and maintenance for the standalone desktop version. Should significant defects require fixing, we will endeavor to release patches or new versions accordingly.
6. Changes and Termination of Terms
We reserve the right to revise these Terms at any time, and your continued use of the Application following any such updates shall constitute your acceptance of the revised Terms. If you do not agree with the changes made, you should cease using the Application.
7. Governing Law and Dispute Resolution
The execution, validity, interpretation, performance, and dispute resolution of these Terms shall be governed by the laws of your country or region. Any disputes arising from the use of this Software shall be resolved amicably through consultation between both parties. In the event that no agreement can be reached, either party may bring suit before the courts of your country or region.
